Mr StephenYankson and Isaac Crayner from Ajumako are praying the Cape Coast High Court to declare the confirmation of Mr Peter Light Koomson as the District Chief Executive (DCE) for the Ajumako-Enyan-Essiam (AEE) District, null and void.
They are also seeking that the court place a perpetual injunction restraining Mr Koomson from holding himself out or performing any public or quasi-public function as the DCE for the District.
In their statement of claim, the two who also sued the District’s Electoral Commission (EC), further prayed the court to order the EC to reverse the purported declaration of Mr Koomson as the DCE.
The statement said to be duly declared as the DCE, one had to obtain two-thirds majority of the 65 member assembly present and this amounted to 45 votes.
It stated that the revocation of the appointment of eight members of the then existing government nominees of the AEE District Assembly and the subsequent appointment of eight new members who were sworn in, was in contravention of the standing orders of the Assembly and this should be declared null and void.
It is also seeking a perpetual injunction restraining the Ministry of Local Government from presenting Mr Koomson to the President of the Republic of Ghana for the purposes of confirming and giving him instrument of office as the DCE for AEE District Assembly.
The case has been adjourned to Tuesday, October 15.
