Mpape Killing: Court Fixes Nov 7 For Police Motion

An Abuja High Court in Apo has adjourned to November 7, 2013, to allow the police move a motion seeking to remove the police from a suit seeking compensation for the murder of a housewife.


Earlier, the court had discharged three out of the seven banks involved in a garnishe proceedings seeking to enforce the May 4, 2012 judgement in a civil suit against the police by the family of late Mrs Doris Okere Shot dead by a mobile policeman at Mpape, a suburb of Abuja on January 31, 2011.

The three discharged garnishe banks, Zenith, Diamond and Access were discharged based on their affidavit filed to show cause as the 1st 6th and 7th garnishe respondents.

The court had on April 22, 2013, issued a garnishe order against the UBA Plc, Police Microfinance bank, First bank, the CBN and the three discharged banks.

At the last sitting, Justice Ufot Inyang, the presiding Judge, discharged the 1st (first) garnishe, Zenith bank from the order dated April 22 and proceedings based on its affidavit to show cause dated May 8, 2013.

Both the 6th garnishe (Diamond Bank and the 7th, Access Bank) were also discharged from the said garnishe order of the court and proceedings based on their affidavit to show cause dated 8th and 24th May 2013 respectively.

All the banks except the 4th (Police Microfinance bank) filed its affidavit as demanded by the said order and the garnishe order of the 4th is hereby made absolute”, the court said.

The police had succeeded in slowing down the commencement of hearing in the said proceedings through a motion filed on May 31, arguing among other things, against jurisdiction and the need to vacate the order against the police Microfinance Bank and the police as an organisation.
