THE ailment of the presiding magistrate of a Lagos coroner court, Mr. Oyetade Komolafe, has stalled the inquest into the June 3, 2012, crash of a Dana Air plane in Lagos.
Sources, including lawyers, who are involved in the proceedings, told our correspondent that Komolafe’s sickness had stalled the proceedings for three months.
Komolafe, who last sat on May 21, 2013, had adjourned till July 3 for the continuation of hearing.
The sources said the coroner was unable to sit on the scheduled date due to his illness. The nature of ailment was unknown to them.
Our correspondent’s last check on Thursday showed that no new date had been fixed for the hearing to continue.
It was also learnt that whenever hearing resumes, the coroner will no longer sit at the courtroom of the Lagos High Court, Ikeja, where previous proceedings had held.
The courtroom, which is ordinarily meant for a judge, was said to have been assigned to one of the newly-appointed judges in the state.
It will be recalled that the hearing was transfered to the courtroom from Abule-Egba Magistrate’s Court after the place could not comfortably accomodate the large number of parties and interested persons in the matter.
The coroner is conducting an inquest into the crash of Dana Air’s MD-83 plane in Iju-Ishaga area of Lagos State, which claimed the lives of 153 persons on board the plane and others on the ground.
The coroner had, at the last proceeding, closed the testimony of Dana Air’s Director of Flight Operations, Mr. Oscar Wilson, after all the lawyers cross-examined the witness.
He had subsequently adjourned till July 3 and 4 for the Lagos State Chief Medical Examiner, Prof. John Obafunwa, and AIB’s consultant, Prof. Adekunbi Banjo, to appear before the court.
